Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and MLPipes LLC (“Company,” “we,” “our,” or “us”) regarding your use of the myCARI mobile application (the “App”).

By downloading, installing, or using myCARI, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

IMPORTANT: Product Classification

myCARI IS A CONSUMER WELLNESS APPLICATION, NOT A MEDICAL DEVICE.

myCARI is designed for daily care oversight, wellness tracking, and communication coordination. myCARI and all associated services:

  • ARE NOT medical devices as defined by the FDA or any regulatory authority
  • ARE NOT intended to diagnose, treat, cure, or prevent any disease or medical condition
  • ARE NOT substitutes for professional medical advice, diagnosis, or treatment
  • ARE NOT emergency response systems or medical alert devices
  • ARE NOT designed to replace the judgment of healthcare professionals
  • DO NOT provide medical advice of any kind

By using myCARI, you acknowledge this classification and agree to use the app only for its intended wellness and coordination purposes.

Description of Service

myCARI is a personal health management application that provides:

  • Health and wellness metric tracking
  • Medication management and reminders
  • Medical appointment scheduling
  • Integration with Apple HealthKit
  • Healthcare provider record integration (import and organize records from Epic MyChart and other FHIR-enabled providers into your unified health timeline)
  • Care team collaboration features
  • AI-powered health insights and daily coaching
  • AI Meal Tracker (photo-based nutrition logging)
  • Secure messaging between care team members (individual and group)

Eligibility

To use myCARI, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the App under applicable laws

If you are using myCARI on behalf of someone else (as a caregiver), you represent that you have proper authorization to do so.

Account Registration

Creating an Account

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account

Account Security

  • Use strong, unique passwords
  • Enable biometric authentication when available
  • Do not share your account credentials with others
  • You are responsible for all activities under your account

Subscription and Payments

Pricing Plans

myCARI offers three tiers of access:

Free Trial

New users receive a 30-day free trial with full access to premium features.

  • No payment required to start your trial
  • Full access to all premium features during trial
  • Trial begins when you create your account
  • At the end of 30 days, you will be automatically moved to the Free Tier unless you subscribe
  • You will receive reminders before your trial ends (7 days, 3 days, and 1 day before expiration)

Free Trial Eligibility

The 30-day free trial is available only to first-time subscribers within the myCARI subscription group. The following users are not eligible for a free trial:

  • Previous subscribers: Users who previously held an active subscription (monthly or annual) and cancelled are not eligible for a new free trial if they resubscribe. Resubscribing will begin a paid billing cycle immediately.
  • Plan upgrades: Upgrading from a monthly subscription to an annual subscription does not include a free trial. Your annual billing begins immediately upon upgrade.
  • Restored purchases: Users who restore a previous subscription purchase are not eligible for a new trial period.

This is enforced by Apple's App Store subscription system and applies to all subscriptions within the same subscription group.

Free Tier

The Free Tier is available to:

  • Trial users who choose not to subscribe after their 30-day trial
  • Care team invitees who choose not to subscribe after their 30-day trial
  • Canceled subscribers after their paid period ends

Free Tier users can continue using myCARI indefinitely with limited features:

Important: Your health data is never deleted when you move to Free Tier. All your historical data remains accessible within the Free Tier feature limits.

Care Team Access

For Primary Users (Subscribers)

Premium subscribers can invite unlimited care team members to view and collaborate on their health data at no additional cost.

For Care Team Invitees

When you are invited to join someone's care team:

  1. 30-Day Free Trial - First-time care team invitees receive a full 30-day premium trial (subject to free trial eligibility — see above)
  2. Care Team Access is Always Free - Viewing the Primary User's health data (as their care team member) is always free, regardless of your subscription status
  3. After Trial Ends - You are moved to the Free Tier unless you subscribe
  4. Optional Premium Upgrade - Subscribe only if you want premium features for your own health tracking

What Care Team Invitees Can Do for FREE (Forever):

  • View the Primary User's health data (based on permissions granted)
  • Receive SOS and fall detection alerts from the Primary User
  • Send messages to the Primary User and other care team members
  • Log vitals and medications on behalf of the Primary User (if permitted)

What Requires Premium (For Your Own Account):

  • Tracking more than 3 of your own medications
  • Inviting care team members to view your own data
  • AI Health Coach for your own health
  • AI Meal Tracker for your own meals
  • MyChart/FHIR import for your own medical records

Professional Caregivers

Care team members can be on unlimited care teams — ideal for professional caregivers, home health nurses, or family members caring for multiple people. No subscription required to serve as a care team member.

Billing

  • Payment is processed exclusively through Apple's App Store. MLPipes LLC does not collect or process payment information directly.
  • Prices may change with 30 days notice
  • Price changes do not affect current subscription period

Auto-Renewal

Your subscription automatically renews at the end of each billing period (monthly or annually) unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan ($9.99/month or $79.99/year). You can manage and turn off auto-renewal by going to your device's Settings > [Your Name] > Subscriptions after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Subscription Cancellation

You may cancel your subscription at any time. Cancellation prevents future billing but does not terminate your current subscription period.

Monthly Subscriptions

  • Upon cancellation, your subscription remains active until the end of your current monthly billing period
  • You retain full access to all premium features until that date
  • No further charges will be made after cancellation
  • At the end of your billing period, you will be downgraded to the Free Tier

Annual Subscriptions

  • Upon cancellation, your subscription remains active until the end of your current annual billing period
  • You retain full access to all premium features until that date
  • Annual subscriptions are non-refundable. We do not provide prorated refunds for unused portions of annual subscriptions.
  • No further charges will be made after cancellation
  • At the end of your billing period, you will be downgraded to the Free Tier

Example: If you purchase an annual subscription on January 1, 2026, and cancel on June 15, 2026, you will retain full premium access until December 31, 2026. No refund will be issued for the remaining 6 months, and you will not be charged again on January 1, 2027.

How to Cancel

  • App Store Subscriptions: Cancel through Settings → [Your Name] → Subscriptions on your iOS device
  • Cancellation must be completed at least 24 hours before your renewal date to prevent the next charge

Data Retention After Cancellation

  • Your health data is retained and remains accessible
  • Free Tier limitations apply after your subscription period ends
  • You may re-subscribe at any time to regain premium access

Refund Policy

All myCARI subscriptions are purchased through the Apple App Store. Apple is the merchant of record and handles all billing and refunds.

To request a refund, visit reportaproblem.apple.com, sign in with your Apple ID, find your myCARI purchase, and submit your request. Apple's refund policies apply to all purchases.

MLPipes LLC does not process refunds directly. For billing questions or issues with your subscription, contact support@mlpipes.ai and we can help you navigate the process.

User Conduct

Acceptable Use

You agree to use myCARI only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You agree NOT to:

  • Use the App for any illegal purpose
  • Impersonate another person or entity
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to our systems
  • Upload viruses, malware, or malicious code
  • Harvest or collect user information without consent
  • Use the App to harass, abuse, or harm others
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App for commercial purposes without authorization

Care Team Conduct

When participating in care teams:

  • Respect the privacy of primary users
  • Only access health information for legitimate caregiving purposes
  • Do not share health information with unauthorized parties
  • Report any security concerns immediately

MLPIPES LLC IS NOT PROVIDING ANY MEDICAL ADVICE OF ANY KIND.

The information provided through myCARI is for general wellness and informational purposes only. It is not intended to be, and should not be used as, a substitute for professional medical advice, diagnosis, or treatment.

YOU MUST:

  • Always seek the advice of your physician or qualified healthcare provider
  • Never disregard professional medical advice because of information from myCARI
  • Never delay seeking medical care based on myCARI data or notifications
  • If you think you may have a medical emergency, call 911 immediately

MLPipes LLC is not a healthcare provider, medical practice, or licensed medical facility. We do not provide medical diagnoses, treatment recommendations, or clinical care of any kind.

Not Medical Advice

IMPORTANT: myCARI is not a substitute for professional medical advice, diagnosis, or treatment.

  • The App provides health tracking and information tools only
  • Always consult a qualified healthcare provider for medical decisions
  • Never disregard professional medical advice based on App information
  • Seek immediate medical attention for emergencies

AI-Generated Insights

  • AI health insights are generated by Google Gemini AI and are for informational purposes only
  • General wellness guidance is based on published guidelines from the WHO, AHA, and USDA Dietary Guidelines for Americans
  • AI recommendations are not medical diagnoses
  • AI analysis may contain errors or inaccuracies
  • Always verify AI suggestions with healthcare professionals

AI Meal Tracker

  • Meal photos are analyzed by Google Gemini AI; nutritional estimates reference the USDA FoodData Central database
  • Meal photo analysis provides estimates, not exact nutritional values
  • AI may misidentify foods or portion sizes
  • Nutritional calculations are approximations based on visual analysis
  • You should verify critical dietary information with nutrition labels or professionals
  • Meal photos are stored securely in Google Cloud Storage and are not shared with third parties for marketing
  • You retain ownership of photos you upload

Computed Wellness Indicators

myCARI provides several computed wellness indicators that are consumer wellness estimates only and are NOT medical measurements, diagnostic tools, or clinical assessments:

  • Metabolic Health Score — A wellness overview combining activity, nutrition, sleep, hydration, and other lifestyle factors into a general wellness score. It is NOT a clinical metabolic panel, NOT a diagnostic tool for diabetes, metabolic syndrome, or any chronic condition, and should NOT be used to monitor or manage any medical condition. It is designed to help users understand general wellness trends and support healthy lifestyle choices.
  • Estimated Cortisol — A proxy wellness indicator derived from biometric patterns (heart rate variability, sleep, activity). It is NOT a laboratory cortisol measurement, NOT a blood test equivalent, and should NOT be used to diagnose or monitor adrenal disorders, Cushing's syndrome, or any medical condition.
  • Stress Level — An algorithmic estimate based on heart rate variability, resting heart rate, sleep, respiratory rate, and other biometric signals. It is NOT a clinical anxiety, mental health, or stress assessment.
  • Energy Level (Body Battery) — An algorithmic estimate of recovery and readiness based on sleep, activity, and rest patterns. It is NOT a clinical fatigue assessment or diagnostic measurement.

These indicators are intended solely to help users with daily wellness awareness and support healthy lifestyle and longevity goals. They should never be used for clinical decision-making. Always consult a qualified healthcare provider for medical concerns.

Data Accuracy

  • You are responsible for the accuracy of manually entered health data
  • We do not guarantee the accuracy of Apple Health data synchronization
  • Medication reminders are aids, not guarantees of adherence
  • ANY ACTIONS YOU TAKE BASED ON CONTENT, NOTIFICATIONS, REMINDERS, OR INFORMATION PROVIDED BY MYCARI ARE TAKEN AT YOUR SOLE RISK.

Healthcare Provider Disclaimer

If you are a professional caregiver, family caregiver, or healthcare professional who uses myCARI:

  • You acknowledge that myCARI is a supporting tool only and is NOT an alternative for performing professional duties
  • Health information must be integrated with clinical records and correlated with other clinical data as required by professional standards
  • Treatment decisions remain your sole responsibility
  • MLPipes LLC assumes no liability for clinical decisions based on myCARI data

SOS Feature Disclaimer

IMPORTANT: SOS DOES NOT CALL 911

The myCARI application includes an SOS feature that sends notifications to your designated care team members. BY USING THE SOS FEATURE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

What SOS Does:

  • Sends push notifications to care team members you have approved
  • Shares your location with care team members (when location permissions are granted)
  • Logs the SOS event for your records

What SOS Does NOT Do:

  • DOES NOT contact 911, emergency services, police, fire departments, or medical responders
  • DOES NOT guarantee delivery of notifications (dependent on network conditions and device settings)
  • DOES NOT guarantee that care team members will see, read, or respond to alerts
  • DOES NOT guarantee any specific response time
  • DOES NOT provide any emergency response services

SOS Limitation of Liability

MLPipes LLC provides the SOS feature solely as a communication tool between you and your care team members. MLPipes LLC IS NOT AN EMERGENCY SERVICE PROVIDER and expressly disclaims all liability for:

  1. Any failure of care team members to respond to SOS alerts
  2. Any delays in notification delivery
  3. Any failure of care team members to contact emergency services on your behalf
  4. Any injury, harm, medical condition, or death resulting from use of or reliance on the SOS feature
  5. Any technical failures preventing SOS alerts from being transmitted or received

Your Responsibility for Emergencies

  • FOR LIFE-THREATENING EMERGENCIES, ALWAYS CALL 911 (or your local emergency number) DIRECTLY
  • Do not rely solely on the SOS feature for emergency response
  • Ensure your care team members understand their role and responsibilities
  • Keep your emergency contact information up to date

Fall Detection

Fall detection notifications are subject to the same limitations:

  • Fall detection is NOT guaranteed to detect all falls
  • Notifications are sent to care team members only, NOT emergency services
  • YOU must contact 911 directly for medical emergencies
  • Fall detection depends on device sensors and may produce false positives or miss events

Technical Limitations

  • SOS and fall detection features depend on device connectivity, battery, and functionality
  • Notifications are sent through third-party services (Apple Push Notification Service, Firebase Cloud Messaging) over which MLPipes LLC has no control
  • We cannot guarantee delivery, timeliness, or receipt of any notification

Platform Role and Care Team Disclaimer

MLPipes LLC's Role

MLPipes LLC operates myCARI solely as a technology platform facilitating communication between users and their personally-selected care team members.

What We Are:

  • A software platform providing communication tools
  • A wellness tracking application
  • A care coordination tool

What We Are NOT:

  • A healthcare provider or medical facility
  • An employer or supervisor of care team members
  • A home health agency or care placement service
  • An emergency response service
  • Responsible for care team member conduct

Care Team Member Conduct Disclaimer

MLPipes LLC does not employ, train, supervise, credential, or control care team members. Users are solely responsible for:

  • Selecting appropriate care team members
  • Verifying qualifications, credentials, and references
  • Establishing care protocols and expectations
  • Supervising care as appropriate
  • Ensuring care team members understand emergency procedures

MLPipes LLC IS NOT RESPONSIBLE FOR ANY ACTIONS, INACTIONS, NEGLIGENCE, OR MISCONDUCT OF CARE TEAM MEMBERS, regardless of whether such conduct occurs in connection with use of myCARI. This includes but is not limited to:

  • Failure of care team members to respond to notifications or alerts
  • Failure of care team members to provide adequate care
  • Failure of care team members to contact emergency services
  • Any medical decisions made by care team members
  • Any harm resulting from care team member conduct

No Agency Relationship

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between MLPipes LLC and any care team member. Care team members are independent individuals selected by users, not agents or employees of MLPipes LLC.

Screening Limitations

myCARI does not conduct background checks, credential verification, or identity verification on care team members. Users are solely responsible for vetting and selecting their own care team members.

Care Team Features

Primary User Rights

As a primary user (account holder), you:

  • Control all access to your health data
  • Can invite and remove care team members
  • Set permission levels for each care team member
  • Can revoke access at any time
  • Can create group chats with your care team members
  • Are the administrator of any group chats you create
  • Are solely responsible for selecting and vetting your care team members

Care Team Member Requirements

Before accessing a primary user's health data, care team members must:

  • Accept the Care Team Member Agreement
  • Acknowledge their HIPAA-related responsibilities
  • Agree to confidentiality requirements
  • Understand that their access is logged for compliance
  • Acknowledge that MLPipes LLC is not responsible for their conduct

Care Team Member Responsibilities

As a care team member, you:

  • May only access data for legitimate caregiving purposes
  • Must respect privacy settings established by the primary user
  • Cannot share health information without authorization
  • Must maintain confidentiality of all health information
  • Understand that your access to PHI is logged and auditable
  • Are solely responsible for your own actions and decisions
  • Must contact 911 directly if you believe a patient is experiencing a medical emergency

Messaging

Individual and Group Messages

  • Messages between care team members are stored securely
  • Primary users can create group chats with their care team
  • Only the primary user (patient) can create or administer group chats
  • Group administrators can add/remove members and rename groups

Message Retention and Deletion

  • You can delete messages from your view
  • You can “unsend” messages you sent (removes from all views)
  • Important: For HIPAA compliance, original message content is retained in secure audit logs even after deletion
  • Message audit logs are retained for a minimum of 6 years
  • We may monitor messages for safety, abuse, and compliance purposes

Prohibited Content

Inappropriate messages may result in account termination, including:

  • Harassment or abusive content
  • Spam or commercial solicitation
  • Content unrelated to health or caregiving
  • Sharing of PHI with unauthorized parties

Intellectual Property

Our Property

myCARI and all content, features, and functionality are owned by MLPipes LLC and are protected by copyright, trademark, patent, and trade secret laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, for personal, non-commercial purposes.

Your Content

You retain ownership of health data and content you provide. By using the App, you grant us a license to use, process, and store your data as necessary to provide the service.

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

Third-Party Services

Integrations

myCARI integrates with third-party services including:

  • Apple HealthKit
  • Firebase (Google)
  • Healthcare provider systems (FHIR)

Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App. Your use of third-party services is subject to their respective terms and privacy policies.

No Endorsement

Integration with third-party services does not constitute endorsement by us or them.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

Disclaimers

“AS IS” Basis

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF HEALTH DATA

No Guarantee

We do not guarantee that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from the App will be accurate or reliable

Limitation of Liability

Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MLPIPES LLC SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or business opportunities
  • Personal injury, illness, worsening medical condition, or death
  • Property damage
  • Medical expenses or healthcare costs
  • Damages arising from care team member conduct, negligence, or failure to respond
  • Damages arising from SOS feature use or non-response
  • Damages arising from notification delivery failures
  • Damages arising from reliance on myCARI data or information
  • Any damages arising from:
    • Your use or inability to use the App
    • Unauthorized access to your data
    • Errors or omissions in health information
    • Third-party conduct or content
    • Technical failures or service interruptions

Specific Liability Disclaimers

MLPipes LLC expressly disclaims liability for:

  1. Medical Outcomes - Any injury, illness, worsening condition, or death resulting from reliance on myCARI or failure to seek professional medical care
  2. Care Team Conduct - Any harm resulting from the actions, inactions, negligence, or misconduct of care team members, including failure to respond to SOS alerts
  3. Emergency Response - Any harm resulting from failure to receive timely emergency response, including but not limited to SOS alerts not being responded to
  4. Data Reliance - Any decisions made based on data displayed in myCARI, including medication information, vital signs, or health records
  5. Technical Failures - Any harm resulting from app crashes, notification failures, data loss, or service interruptions

Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: The amount you paid us in the 12 months before the claim, or Twenty-Five Dollars ($25.00 USD).

Essential Purpose

These limitations apply even if remedies fail their essential purpose.

Acknowledgment

You acknowledge that myCARI is a wellness coordination tool and NOT:

  • A medical device
  • An emergency response system
  • A substitute for professional medical care
  • A guarantee of care team member availability or response

Indemnification

You agree to indemnify, defend, and hold harmless MLPipes LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of myCARI
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any dispute between you and a care team member
  • Your provision of inaccurate or incomplete information
  • Any claim that your use of myCARI caused harm to a third party
  • Your health data or content

This indemnification obligation survives termination of your account and these Terms.

Modifications to Service

We reserve the right to:

  • Modify or discontinue the App at any time
  • Change features, functionality, or pricing
  • Impose limits on certain features

We will provide reasonable notice of material changes when possible.

Modifications to Terms

We may modify these Terms at any time. Changes are effective when posted. Your continued use after changes constitutes acceptance. We will notify you of material changes via:

  • In-app notification
  • Email to your registered address

Termination

By You

You may delete your account at any time by:

  • Using the Delete Account option in the App (Profile > Delete Account)
  • Contacting us at support@mlpipes.ai

If you have an active subscription, you must cancel it separately in your device's Settings > Subscriptions before deleting your account. Deleting your account does not automatically cancel your Apple subscription.

By Us

We may terminate or suspend your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Create risk or legal exposure for us

Effect of Account Deletion

Upon account deletion:

  • Your right to use the App ceases immediately
  • Your account and all associated health data — including vitals, medications, appointments, meals, workouts, sleep data, AI Health Coach analyses, and care team memberships — are permanently removed from active systems within 30 days
  • Backup copies may be retained for up to 90 days before permanent removal
  • HIPAA audit logs and compliance records (including a record of your account deletion) are retained for 6 years as required by law
  • Care team messages you sent are retained in audit logs for HIPAA compliance but removed from active views
  • Apple subscription not affected: Account deletion does not cancel your Apple subscription. You must separately cancel in your device's Settings > Subscriptions to stop future charges. Apple manages all billing independently of your myCARI account.
  • Provisions that should survive termination will survive

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@mlpipes.ai to attempt informal resolution.

Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, except:

  • Small claims court actions
  • Injunctive relief for intellectual property violations

Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS.

Governing Law

These Terms are governed by the laws of the State of Nevada USA, without regard to conflict of law principles.

General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, HIPAA Authorization Notice, and Care Team Member Agreement, constitute the entire agreement between you and us regarding the App.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce a provision does not waive our right to enforce it later.

Assignment

You may not assign these Terms. We may assign our rights without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

  • In-app notifications
  • Email to your registered address
  • Posting on our website

Apple-Specific Terms

The following terms apply to users who download or use myCARI through the Apple App Store. You acknowledge and agree that:

  1. Acknowledgement: These Terms are between you and MLPipes LLC only, and not with Apple Inc. (“Apple”). MLPipes LLC, not Apple, is solely responsible for the App and its content.
  2. Scope of License: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  3. Maintenance and Support: MLPipes LLC is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  4. Warranty: MLPipes LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
  5. Product Claims: MLPipes LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of HealthKit and Clinical Health Records frameworks.
  6. Intellectual Property: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, MLPipes LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  7. Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
